English Summary

The project "Forenkling af kommunale regulativer" (Simplification of municipal waste regulations) is part of a series of projects, which was started by the Minister of Environment in 2002. These projects concentrate on the future organization of the waste management sector in Denmark.

The project has been divided into 4 phases. Each phase is described in detail in separate reports:

  • Phase 1: Mapping of national rules and legislation
  • Phase 2: Text proposals for municipal waste regulations
  • Phase 3: Proposals for amendments of the statutory order on waste
  • Phase 4: Electronic dissemination of knowledge.

Phase 1 included a systematic survey and legal assessment of rules and regulations in force. As a consequence a number of similar provisions have been identified which is of great importance for the content of the waste regulations.

Phase 1 identified a number of provisions, which can be determined clearly from the national provisions. It will be possible to formulate these provisions identically in all regulations. Also, the survey in phase 1 has identified provisions, where due to differences in the municipal level of services and designs of waste schemes, will be appropriate with a certain level of municipal optional choice. However, still these different options should be formulated in a uniform manner. Further more, provisions have been identified where free municipal optional choice will be appropriate.

Finally, a functional and provisional structure for an Internet based module (module1) has been developed. This module will contain an overview of national rules and regulations in force.

An analysis of the needs and screening of conditions for the setting up template and structure of waste regulations were carried out in phase 2. According to recommendations from phase 1, specific text proposals for regulations for respectively, household waste and industrial waste, were set up. Each regulation contains a general part and a specific part, which describes specific waste schemes.

Proposal for structure for a functional Internet based module (module 2) was also set up in phase 2. Module 2 is the tool, which will make it possible for municipalities to work out, edit and approve municipal waste regulations. Finally, an assessment of saved resources and administrative burdens due to the project was carried out in phase 2.

Proposals for specific amendments in the Environmental Protection Act and the Statutory Order on Waste were set up in phase 3. This includes provisions for obligatory use of the proposed templates and Internet based tool for municipal waste regulations.

Proposals for new provisions or for the amendment of existing provisions has been set up in order to eliminate indistinct or inappropriate provisions, definitions and terminologies.

An Internet based system for reporting and distribution of data on municipal waste regulations was developed in phase 4 (module 3). The system is available on www.affaldsdata.dk.
